Kappa Alpha under investigation by Judicial Affairs

The Kappa Alpha fraternity is under investigation by the campus police and have charges pending by Judicial Affairs after a party at their house on Greek Row that was held Friday, Nov. 30.

According to a report issued by campus police, who Chief Buddy Peaster said are "nearing the end of their investigation," a police officer was dispatched to Middle Tennessee Medical Center Emergency Room on Dec. 2 in regards to a possible sexual assault victim.

The female student was being held at MTMC because of an earlier suicide attempt and had to be transported to the hospital by campus police from her Womack Lane residence according to the report.

"This victim stated that on Friday, Nov. 30 she was at a party located on Greek Row and that she may have been sexually assaulted that evening," stated the police report, "This officer notified the MTSU investigators, who responded to the MTMC ER for further investigations."

Campus police conducted an investigation where several individuals at the party were interviewed to ascertain clearly whether or not this was a case of rape or consensual intercourse.

The alleged victim had a vaginal exam by a nurse and there was evidence of intercourse.

After several interviews with the alleged victim, the alleged assailant, and several others who attended the party, Peaster said that there is not enough evidence to prosecute the alleged sexual assailant from the state law perspective.

Nine interviews were included in the police report and each one varies on the details of how the evening of the alleged rape progressed.

One of the interviews of an attendee of the party from the police report said that the alleged victim had been seeing her alleged assailant "on and off recently."

"She was smiling and flirting. She then went to the quad area where she let her top part of her dress fall off. Several females said something to her about shutting her legs because their boyfriends were in the room and they were getting upset," said the attendee.

During another interview conducted with a different attendee of the party she said that an unknown male accompanied the alleged victim to the alleged assailants' bedroom and stated, "I put that little slut in [his] bed, I left him a present."

"We have spoken to the district attorney's office about this case and we believe that there is enough information in this situation that sexual intercourse occurred, but there is not enough evidence for assault to be confirmed," Peaster said. "That can be extremely frustrating in cases such as these."

Oh, I have no doubt they will be cleared. Look at who runs judicial affairs. I am sure the student investigators and student judges will all wear their fraternity pins to the hearing and go out for a drink afterward with the accused. (Continued…)

It sounds to me like KA was having a party and alcohol was involved, not that that is a fact listed, but an assumption that sounds likely. The girl was probably drunk when she arrived and probably provided more alcohol by the members of the fraternity. (Continued…)

I'm SURE there wasn't any alcohol on campus during this party either... This girl was flirting and spreading her legs because she was just so excited to be there, right? Ha ha! Hey MTSU "police" - when will you quit looking the other way?

She MAY have been sexually assaulted? Sounds like she MAY have been drunk and flirting with her on and off boyfriend who then had sex with her.

Doesn't matter. If she was drunk, she couldn't consent. And if she was as drunk as it seems she was then most definitely end of story. Last time I checked women weren't property to be used and abused. (Continued…)

...Nope I actually think Sidelines, just might not be acting anti-Greek on this one. Kinda seems like they're reporting the news here and that the corresponding editorial just states that judicial affairs shouldn't be involved. (Continued…)

Its amazing how quick anti-greek individuals are to chastise the entire organization without honestly knowing the facts. What about the situation that this could be an angry ex-girlfriend who went to their house simply to anger the ex-boyfriend by trying to sleep with his fraternity brothers. (Continued…)

It would definitely suck to be the guy who's getting the charges against him, because it says in the article that some other guy took the girl up to his room and left him a little present, and she was his on and off girlfriend, so what did he do? woke up in the middle of the night and had sex with her.
